Subject: Herbicide Drift

The local farmer had is field sprayed with 2.4.D The wind blow the herbicide on to our plants, severely damaging them. I want the company that sprayed the field to pay me for my damaged plants. What is this lose worth.

Dang! That's a tough question Glen. Since its not a cash crop, it will be hard to determine.
If you can itemize what you put into the soil prep and plant growth so far for this year, including your time, then refer back over last 3 years in prize monies to determine financial loss. But at the end of the day its just a hobby.
It may be better to just work out an agreement so it doesn't happen again. We are within 50 feet of a soybean field. The farmer there (so far) has been very very careful when he sprays. He sprays early in the season when we have them in huts (and we go close them when we see him coming), we always put our wind fence up on that side first for extra protection, he reduces the spray, goes super slow and lowers his boom till it almost touches the ground and never sprays if there is a wind. Maybe you can work something out so he will notify you and be more careful.
But DAMN that really sucks!

file a complaint with the state they could also be fined have license revoked if they ever had 1 to begin

Cecil and Don make good points. I deal with the same problem. Wait till the Crop Dusters arrive. Talk about little control. I had a talk with the company that sprays around me and their pretty good about lowering the spray boom for a few hundred feet off my patches. As far as getting anything for damages Good Luck. Not to be negative but I doubt you can recieve anything for damages unless your patch was there long before the Row Crops. These Pumpkins can be listed as Cash Crops if you have plans of selling them whole or for seeds. Even plans of seed donations to clubs equals an accountable value . Its a tuff call. Maybe someone halfway near you is on here and has extra back up plants? Sorry you got Hit Like That.

Same thing happen to me a couple years back. It killed my patch. There was no coming back from it that year. One year lost. I don't grow in that spot anymore. It sucks and its sad, but really what can you do. And to add to my bad luck,, I lost the patch to yvd the year before. So I just had to move to a new spot.

I think there are laws about spraying and maximum wind speed, like not spraying in winds over 20mph, maybe if you could prove wind speed that day it would help you

We have had problems in the past. A new zero vapor pressure 2-4,d is supposed to be released this year to be targeted to grape growing areas of the country. Grapes are also very sensitive.
Some wind is good as it can prevent a stagnant vapor layer on the ground. Too much wind can blow spray mist or droplets. Label normally states something like 3-12 mph. My opinion is most 2,4-d damage is from evaporation of the chemical and then is basically vapor damage.
Total bummer. If they live they grow fast but may abort fruit.

I have meet with the company that sprayed the field. We can not agree on a price of the damage. I am asking $1,000 per plant. They think I am crazy.

Growers beware... New Grass/Weed Killer has 2-4D mixed with the Glyphosphate.. READ THE LABELS before you buy. I have found TDK at Home Depot.. 41% Gly with NO 2 -4 D.. Stop wasting money buying watered down RoundUp... 6 OZ per gallon... itZ a scam... half aZ much good stuff.... Save your money... work smarter not harder..

Glen, consider what you would win if you won your local weigh off & ask for that amount. If not then tell him that you will report them to the Department of Agriculture for improper spaying practices. I'm sure the fines would be much higher than what your asking for. You could just add up your true costs,soil additives,seed cost,everything you have sprayed,anything you bought,hoses,plastic,sprinklers..(pay yourself labor rates)for tilling etc. Give him one chance to pay it..if he don't, report him and add in your potential prize money when you sue for dmgs! The problem with reporting him without the opportunity to rectify is...we all make mistakes.
